In March of 2017 Fiat Chrysler Automobile has been hit will two lawsuits for age discrimination. Press, T. B. (2017, states that “one alleging it mistreats older employees during their performance evaluations and as a result gives them lower pay and fewer promotions than their younger counterparts. Among the allegations: That employees’ photographs are used during the performance review process at Fiat Chrysler. According to the lawsuit filed Feb. 27 in U.S. District Court, Fiat Chrysler’s upper-level managers who rarely work with the employees they are evaluating have the workers’ photo displayed in front of them when they are rating their performance.”My feeling towards this incident is that just because the employee is getting older doesn’t mean they need to be treated differently. We all grow older as the years go on. If someone is not actually watching them work how can they say they perform to a lower standard? That’s insane and simply sad. 9 times out of 10 the older employee has better work ethic then the younger employee.As far a solution? I believe each employee should be treated with the same respect no matter what age they’re. While pay may still be different seeing that an entry level employee is not expected to be paid like a veteran or CEO. The former employees claim, based on a company directive that the company chose to release employees over forty years old in favor of hiring personnel in their twenties (Swartz, 2016). The four plaintiffs in the class action suit are in their fifties and sixties. While I feel, a company must have the right to expect all its employees to remain capable of fulfilling the tasks of position they are in, including physical expectations, short of a conclusive test that proves their inability to perform, it seems shady that lay-offs would focus on employees of a certain age. We have made obvious strides in this country protecting workers from discrimination based on their gender, ethnicity and disabilities; however, workplace rights for the aging may be one of the most difficult to insure. How does someone prove they were denied a position or promotion based on their age? In cases like the HP law suit, where a company directive can be proven, it seems the plaintiffs may have a fighting chance. The lone applicant who is not even considered for a job or laid off from a job based on age discrimination, will have a rougher time providing burden of proof. As a person of age in a field where I work side by side with many coworkers in their twenties, I can sympathize with the plaintiffs in the noted case. I struggle to think of an effective strategy to combat the issue of age discrimination. I do feel that personnel departments should include the topic of age discrimination in their orientation process. I have been working in various arenas in my field for 23 years and I have yet to hear age discrimination stressed in an orientation process. It is usually not mentioned at all. With sexual, religious and racial discrimination issues always covered, including outlining appropriate employee interactions, I think including the rights of the aging would be beneficial.ReferencesSwartz, J.
